DERECHO A LA INDEMNIDAD DEL GOBERNADO*

Resumen. En este ensayo se
plantea un enfoque nuevo para la protección
a la integridad física, psíquica, moral y patrimonial de la persona, a partir
de lo que se denominará como derecho de indemnidad. Este derecho entraña
obligaciones de no vulneración o de actuación de los poderes públicos, seguido
de la garantía de reparación —en caso de lesión—, que en términos de nuestro
bloque convencional tendría como parámetro la plena restitución;
principio que entraña medidas con efectos individuales o colectivos, así
como medidas generales para evitar su repetición. Se argumenta
que todas las instituciones jurídicas que salvaguardan los derechos de las
personas frente a la intervención del Estado deberían tener como orientación
la plena restitución conforme al marco convencional y —desde
la interpretación más favorable a la persona—al principio de complementariedad establecido
por la Ley General de Víctimas. En este sentido, se hace una especial referencia a la responsabilidad
patrimonial del Estado, así como propuestas de reformulación del sistema, desde
la perspectiva de la víctima o afectado, del corpus iuris y de
mecanismos procedimentales empleados por órganos jurisdiccionales
internacionales, para lograr su mayor efectividad.
Abstract. A new
approach for the protection of the physical, mental, moral and patrimonial
integrity of individuals is proposed, based on what will be called ‘the right
of indemnity’. This right entails obligations of non-infringement or action by
the public authorities, followed by the guarantee of restitution -in the event
of tort-, which under the Mexican law would have as a parameter full
restitution; principle that involves measures with individual or collective
effects, as well as general measures to avoid its repetition. In this essay, it
is argued that all legal institutions that safeguard the rights of individuals
before the State´s intervention should be guided by this concept of reparation
in accordance with the conventional framework and from the most favorable
interpretation to the individual, according to the principle of complementarity
established by the General Law of Victims. In this sense, a special reference
is made to both the patrimonial responsibility of the State, as well as
proposals for the reformulation of the system. Such references are made from
the perspective of the victim or plaintiff, the Corpus Iuris Civilis and
procedural mechanisms used by international jurisdictional bodies, in order to
achieve its greater effectiveness.
